Terms of Service

The plain-English version: Obrazo helps you create proposals faster, but every proposal you send is yours — your numbers, your scope, your business. You're responsible for reviewing what you send to your customers. We charge $99 or $299 per month and you can cancel any time. We don't sell your data, we don't share customer information across contractors, and we don't use your work to train AI.

1. Acceptance of these terms

These Terms of Service ("Terms") govern your use of Obrazo, a software service operated by us (the "Service"). By creating an account, paying for a subscription, or using any part of Obrazo, you agree to these Terms.

If you're using Obrazo on behalf of a company or other organization, you represent that you have the authority to bind that organization to these Terms, and the words "you" and "your" mean that organization.

If you don't agree to these Terms, don't use Obrazo.

2. What Obrazo is

Obrazo is a software-as-a-service tool for landscape contractors. It helps you collect site information, generate proposal documents, manage customer records, and send proposals to your customers in English and Spanish.

Obrazo uses artificial intelligence (specifically, large language models from Anthropic) to assemble the text of your proposals based on the information you provide. See Section 6 for important details about how this works and your responsibilities.

We may add features, change features, or remove features over time. We'll give reasonable notice for changes that materially reduce the Service's usefulness for you.

3. Your account

To use Obrazo, you create an account using your email address and a password. You're responsible for:

One account per business. The Crew plan supports multiple team members under one account.

You must be at least 18 years old and have the legal capacity to enter into a contract.

4. Fees and billing

Obrazo is offered on two paid plans: Solo at $99 per month and Crew at $299 per month. Plan details are listed on our pricing page. We may change pricing from time to time; if we do, we'll give you at least 30 days' notice before the change applies to your account.

Subscriptions are billed monthly in advance via the payment method you provide. By providing a payment method, you authorize us to charge your subscription fee on each renewal date until you cancel.

Cancellation

You can cancel your subscription at any time from your account settings. Cancellation stops future renewals. You keep access to the Service through the end of your current billing period.

We don't issue prorated refunds for partial months. See our Refund Policy for details on when we issue refunds.

Failed payments

If a payment fails, we'll notify you by email and give you a reasonable grace period to update your payment method. If the issue isn't resolved, we may suspend or close your account.

Taxes

Listed prices don't include sales tax, VAT, or similar charges. You're responsible for any taxes that apply to your subscription based on where your business is located.

5. Free trial

We offer a 14-day free trial of Obrazo with no credit card required up front. During the trial, you have access to the same features as a paid subscription.

At the end of the trial, your account will pause until you choose a plan and provide a payment method. We won't charge you automatically when the trial ends.

You can use the free trial once per business. We reserve the right to limit or revoke trial access in cases of abuse (multiple accounts created to extend the trial period, automated signups, and so on).

6. AI-generated proposals

This section is important. Please read it carefully.

When you use Obrazo to create a proposal, our software sends the information you provide (site details, materials selected, pricing, your business profile) to a third-party AI service (currently Anthropic's Claude). The AI assembles a proposal document based on your inputs and your saved templates. The resulting document is returned to you for review.

You are responsible for every proposal you send. Before sending a proposal to a customer, you must review it for accuracy. The AI can make mistakes — it can transpose numbers, misinterpret site notes, generate plausible-sounding but incorrect descriptions of materials or processes, or produce text that doesn't match your usual standards. We strongly recommend reviewing every proposal in full before sending.

What we don't promise

We don't guarantee that AI-generated proposals will be free of errors, complete, fit for any particular customer or jobsite, or compliant with the laws of your jurisdiction. The Service is a tool to assist you, not a replacement for your professional judgment.

Pricing accuracy

The dollar amounts that appear in proposals come from data you enter (your unit prices, your selected products, your labor rates). If the math is wrong, the cause is almost always incorrect input data — not the AI. Verify totals before sending.

Translation

Obrazo can translate proposals between English and Spanish. AI translation is generally accurate but not perfect. If your customer reads only Spanish, and the proposal contains terms that matter legally (warranty language, payment milestones, dispute clauses), we recommend having a fluent speaker review before sending.

Use of AI vendors

We currently use Anthropic to provide AI services. We may switch or add AI vendors over time. We don't share your customer data with AI vendors beyond what's necessary to generate the requested proposal, and we don't permit AI vendors to use your data to train their models.

7. Your content

"Your Content" means everything you put into Obrazo: customer information, site notes, photos, your pricing, your business profile, your saved templates, and the proposals you generate.

You own it

Your Content is yours. We claim no ownership over it. You can export or delete your data at any time from your account settings.

What we do with it

We use Your Content only to provide the Service to you. Specifically, we:

We don't sell Your Content. We don't share Your Content with other contractors. We don't use Your Content to train AI models. We don't use customer data from your account for marketing.

Backups and retention

We back up Your Content regularly to prevent data loss. If you cancel your account, we keep Your Content for 30 days in case you reactivate, then delete it permanently.

Limited license to us

You grant us a non-exclusive, worldwide, royalty-free license to use, store, copy, transmit, and display Your Content solely as needed to provide the Service. This license ends when you delete the content or close your account.

8. Prohibited use

You may not use Obrazo to:

9. Service availability

We aim to keep Obrazo available 24/7, but we don't guarantee uninterrupted service. The Service may be unavailable due to maintenance, infrastructure issues, third-party outages (including outages of our AI vendors), or other factors outside our control.

We may schedule planned maintenance and will provide notice when reasonable.

10. No warranty

The Service is provided "as is" and "as available," without warranties of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:

Some jurisdictions don't allow the exclusion of certain warranties. If those apply to you, the exclusions in this section apply only to the extent permitted.

11. Limitation of liability

To the fullest extent permitted by law, our total liability for any claim arising from or related to these Terms or the Service is limited to the amount you paid us for the Service in the 12 months before the event giving rise to the claim.

12. Indemnification

You agree to defend, indemnify, and hold us harmless from any claims, damages, or expenses (including reasonable attorney's fees) arising from:

13. Termination

You can cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period.

We may suspend or terminate your account if:

Where reasonable, we'll give you notice and an opportunity to cure the issue. In cases of severe breach (security incidents, fraud, illegal activity), we may terminate immediately without notice.

Effect of termination

When your account ends, you lose access to the Service. We retain your data for 30 days in case you reactivate, after which we delete it. Sections of these Terms that by their nature should survive termination (including ownership, warranty disclaimers, liability limits, indemnification, and dispute resolution) will survive.

14. Changes to these terms

We may update these Terms from time to time. When we make material changes, we'll notify you by email or by an in-product notice at least 30 days before the changes take effect, except for changes required by law (which may take effect sooner).

Your continued use of the Service after the effective date constitutes your acceptance of the updated Terms. If you don't agree to the changes, your remedy is to cancel your subscription before they take effect.

15. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to its conflict of laws rules.

Any dispute arising from these Terms or the Service must be brought in the state or federal courts located in Orange County, California, and you consent to the personal jurisdiction of those courts.

You and we both waive any right to a jury trial. To the fullest extent permitted by law, you and we both waive any right to participate in a class action.

Before filing a lawsuit, you agree to contact us at legal@obrazo.co to attempt to resolve the dispute informally for at least 30 days.
